OBJECT
These general conditions of sale govern the terms of distance selling between any user of the site www.lespetitespampillesparis.com wishing to make a purchase on the merchant site - and the company MEVA, whose head office is located at 24 rue René Boulanger, 75010 PARIS – owner of the registered trademark Les Petites Pampilles Paris, registered with the RCS of PARIS.
These general terms and conditions of sale apply to all orders placed on the www.lespetitespampillesparis.com website by non-trading individuals. The buyer declares to have full legal capacity. Throughout the site, the terms “we”, “us” and “our” refer to the Les Petites Pampilles Paris brand. The acceptance of the general conditions of sale is carried out by the validation of the order by the customer.
The Customer therefore acknowledges having read and accepted these General Conditions of Sale before placing his order. By proceeding to the payment, the user indicates that he implicitly accepts without reserve all the conditions of sale as well as our conditions of return and exchange. These conditions are the only ones applicable and prevail over all other conditions.
We reserve the right to update, change or replace any part or all of these Terms and Conditions by posting updates and/or changes to our site. It is your responsibility to check them regularly to see any changes.
The conditions applicable to the order of a product by a Customer are those in force on the day of validation of his order. Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products.
ORDER
The customer must imperatively follow the different steps set up on the site www.lespetitespampillesparis.com to validate his order. The customer must fill in his information for his order to be registered. The customer who is not registered must first fill in his information to be able to order. After validation of the payment, the customer receives an e-mail informing him that his order has been registered. Any validated order implies acceptance of all the stipulations and this takes on the value of a contract. It is the Customer's responsibility to verify the accuracy of the information he communicates.
We undertake to honor orders received within the limits of available stocks and in the event of unavailability to inform the customer by any means at his convenience. We will then give you the possibility to choose:
1/ to be delivered a product or service of a quality and price equivalent to that ordered.
2/ To be reimbursed for the price of the product or service ordered within 48 hours (this period is the one we will take to initiate the reimbursement by the same means of payment used when placing your order. It may be that this period is longer to see the refund appear on your PAYPAL or bank account. It depends on your bank or Paypal).
3/ Wait for the product to be available again to be shipped. In this case, the brand undertakes to communicate to you a restocking period and will deliver the product to you when it is available. In the case of this option, if your order contains several products, we will be able to deliver your order to you, in 2 times maximum.
We will therefore deliver the products available when you place your order and the second part during a second delivery which will be at our expense. The customer can request to receive his entire order in a single shipment. In this case, the time will be that of the provision of the product unavailable when placing the order. The Les Petites Pampilles Paris brand reserves the right to refuse, cancel and terminate orders at any time for legitimate and legal reasons (problems related to payment, past history, etc.). In this case, we will inform the Customer.
PRICE
The prices of our products are indicated in euros all taxes included (VAT and other taxes applicable on the day of the order), unless otherwise indicated and excluding processing and shipping costs (which are identified separately). The brand reserves the right to modify its prices at any time without notice but the products already ordered will be invoiced on the basis of the prices in force at the time of registration of each order. The products remain the full property of the Les Petites Pampilles Paris brand until full payment of the price of each order.
For deliveries abroad, customs duties, other local taxes, import duties or state taxes may be payable. These rights and sums are not the responsibility of the company Les Petites Pampilles Paris. They will be at your expense and are your sole responsibility, both in terms of declarations and payments to the competent authorities and bodies in your country. We advise you to inquire about these aspects with your local authorities.
PAYMENT
Payment for product purchases by Customers is made:
- Either by credit card (via stripe)
- Either by PAYPAL.
Cash or check payments are not accepted. Les Petites Pampilles Paris uses the STRIPE service for credit card payments. Stripe offers one of the most secure payment solutions in the world.
The bank card is debited when the order is registered. In the case of a refused credit card transaction, the company invites the Customer to approach his bank, the company cannot be held responsible. Orders are to be paid in full and at one time. The company Les Petites Pampilles Paris has no access to the customer's banking information at any time. This is why his payment information will be requested for each new order.
DISPATCH
The jewels being handmade creations, the packages are shipped between 2 and 3 working days.
If the product is urgent, do not hesitate to let us know when placing the order.
For certain specific orders (personalization requiring welding and gilding), this delay can go up to 2 to 3 weeks.
The deadlines for letters with tracking and colissimo are:
- 2 to 3 working days for France (depending on the Post).
- 3 to 8 working days for Europe
- 5 to 10 working days for international
During the holiday season, post office delays may be extended.
The delivery is made at your choice by:
- FRANCE: Letter with follow-up: €3.50. Free delivery from 70€ of purchase / Colissimo against signature: 8€, free delivery from 120€.
- EUROPE: Letter with follow-up: €6.20. Free delivery from 90€ of purchase / Colissimo against signature: 12.30€. Free delivery from 160€.
The cost of delivery takes into account the rates of La Poste as well as a contribution to the shipping costs (logistics, envelopes, etc.).
DELIVERY RISKS
The company Les Petites Pampilles Paris offers delivery directly to your home or to the address of your choice. The products travel at the risk and peril of the customer to whom it belongs in the event of default or failure to make any necessary disputes and to confirm his reservations by extrajudicial act or by registered letter with acknowledgment of receipt to the carrier within three days following the receipt of goods.
We have chosen to send our orders with the postal services (letter with follow-up or Colissimo with follow-up). However, it is possible, as in any expedition, that there may be a delay in delivery.
The company Les Petites Pampilles Paris and the carriers being distinct and independent entities, the brand cannot be held responsible for any delay and error in delivery or loss of parcels attributable to La Poste. Unless otherwise specified for each product, orders are delivered to the address indicated when ordering within 10 working days of the order confirmation sent to the customer by the company Les Petites Pampilles Paris.
Any reservations concerning the delivery and receipt of the products must be reported within the legal deadlines to the carrier. The tracking number provided by La Poste is valid for two months. No complaint can be made beyond this period.
RIGHT TO RETRACT
In accordance with the provisions of articles L 221-18 and following of the Consumer Code, the Customer may cancel his order without justifying any reason. To do this, he has a right of withdrawal.
He can exercise it within 14 days of receipt of the Product (the postmark being taken as proof). After this time, unfortunately we will not be able to offer you a refund.
Items purchased in our store (online or physical) or during temporary events may be subject to a refund or credit.
Before the expiry of this 14-day period, the Customer must inform the company Les Petites Pampilles Paris of their decision to withdraw by email clearly and unambiguously expressing this decision by mentioning the number of their order to: accueil@lespetitespampilles.com .
The Customer must return the Product, at his own expense (unless the product is not compliant or has a manufacturing defect), to the following address: Les Petites Pampilles Paris, 9, rue de Garches 92210 SAINT CLOUD, within 7 days following the communication of its decision to retract. If the Order is not returned within the time limit, the Order will be deemed final and no refund can be made, with the exception of the cases provided for in these General Terms and Conditions of Sale.
We strongly advise our customers to make their returns with a tracking number and to communicate it to us when sending the package. We would not be held responsible for delays and defects in delivery of the service concerned (Post or any other delivery service).
The deadline is extended for all orders placed during the month of December. You have until January 6 to request a credit note or a refund.
The product must be returned new, in its original packaging (pouch, box, etc.), the reason for the return must be indicated in the package. With regard to returns of personalized products: Article L 121-20-2 of the Consumer Code provides that the right of withdrawal cannot be exercised for contracts for the supply of goods made to the consumer's specifications or clearly personalized. Gift cards cannot be refunded. In the event that an order is part of a particular advertising promotion, the right of withdrawal is cancelled.
Refunds for products will be made within a period of less than or equal to 15 working days after receipt of the products by Les Petites Pampilles Paris. Credit will be automatically applied to your credit card or original payment method. We will also notify you of the approval or rejection of your refund.
GUARANTEE
In accordance with article 217-4 of the Consumer Code, the company Les Petites Pampilles Paris will respond to any lack of conformity (material or manufacture) which would exist when the product is delivered and which appears within a period of one year from count from it.
If the customer uses the products abnormally or not in compliance, the consequences resulting from these uses are excluded from the scope of the current contractual guarantees. The defect will be deemed non-existent if, at the time of the conclusion of the contract, the customer was aware of the lack of conformity or could not reasonably be unaware of it or if the lack of conformity is attributable to him. However, we specify that in this respect it is necessary to take into account the particular nature of our products and that the Customer is required to take care of them, in particular by avoiding any contact of the products with detergents, abrasive products (for example chlorine) or any products containing alcohol. In addition, normal wear and a certain patina linked to the repeated wearing of our products can in no way be considered as a lack of conformity within the meaning of this provision. We invite you to read the advice on maintenance and use on the site. It is agreed that the Customer must notify us of any lack of conformity, in writing or by e-mail to the following address: accueil@lespetitespampilles.com within the warranty period.
Failure to comply with this obligation will result in the loss of the Customer's rights for lack of conformity. Interventions under the warranty cannot have the effect of extending the duration of the latter.
Under this guarantee, the only obligation incumbent on the seller will be the free replacement of the identical product or by any other equivalent product. In the event of the unavailability of a pearl or a component of the jewel recognized as subject to the guarantee of conformity, the company reserves the right to replace it in such a way that its general appearance is as close as possible to its representation and of his photograph on the site www.lespetitespampillesparis.com The jewels must be returned by letter with follow-up or by colissimo against signature in a rigid packaging (in particular for the earrings) and in their original packaging (pouch, case. .) . The tracking number must be communicated to the company by email as well as the original order number.
The brand will repair or replace the product within a maximum period of one month from receipt of the package (as evidenced by the postmark). The return costs will be borne by the customer and the costs of sending the repaired product will be borne by the company.
REPAIR
If you have broken one of your jewels, or the warranty period has passed, we can repair it. We only repair jewelry from the Les Petites Pampilles Paris brand. This service is chargeable.
For this type of request, do not hesitate to contact our customer service at the following address: accueil@lespetitespampilles.com . Please attach a photo of the jewelry to your email so that we can best assist you. After checking the possibility of repairing the jewel, we will offer you a possibility of repair or not.
The repair as well as the shipping costs will be charged to you. An estimate to be validated will be sent to you beforehand.
APPLICABLE LAW AND JURISDICTION
These general conditions of sale are subject to French law. The products offered comply with the French legislation in force. The responsibility of the company Les Petites Pampilles Paris cannot be engaged in the event of non-compliance with the legislation of the country where the product is delivered.
It is up to you to check with the local authorities the possibilities of importing or using the products or services that you plan to order. Furthermore, the company Les Petites Pampilles Paris cannot be held liable for damage resulting from improper use of the purchased product. In the event of a dispute, an amicable solution will be sought before any legal action.
The liability of Petites Pampilles Paris, under the terms of these General Conditions, may not exceed an amount equal to the sums paid or payable during the transaction at the origin of the said liability, whatever the cause or form of the action concerned. . The French courts within the jurisdiction of the Court of Appeal of Paris will have sole jurisdiction.
INTELLECTUAL PROPERTY
The intellectual and industrial property rights protecting all the elements (texts, comments, images, photographs, logos, drawings, videos, etc.) found on the site www.lespetitespampillesparis.com are the property of Les Petites Pampilles Paris. The jewels sold on the site www.lespetitespampillesparis.com are all created and designed by the designer herself and are the intellectual property of Les Petites Pampilles Paris. Any total or partial reproduction of one of these elements without the express prior written authorization of the holder of said intellectual and industrial property rights is strictly prohibited, in accordance with the laws governing intellectual and industrial property.
