OBJECT

These general terms and conditions of sale govern the terms of distance selling between any user of the site www.lespetitespampillesparis.com wishing to make a purchase on the merchant site - and the company MEVA, whose head office is located at 24 rue René Boulanger, 75010 PARIS - owner of the registered trademark les Petites Pampilles Paris, registered with the RCS of PARIS.

These general terms and conditions of sale apply to all orders placed on the website www.lespetitespampillesparis.com by non-commercial individuals. The buyer declares that they have full legal capacity. Throughout the site, the terms "we", "our" and "us" refer to the brand Les Petites Pampilles Paris. Acceptance of the general terms and conditions of sale is made by the validation of the order by the customer.

The Customer therefore acknowledges having read and accepted these General Conditions of Sale before placing his order. By proceeding to payment, the user indicates that he implicitly accepts without reservation all of the conditions of sale as well as our return and exchange conditions. These conditions are the only ones applicable and prevail over all other conditions.

We reserve the right to update, change or replace any part of these Terms and Conditions by posting updates and/or changes to our website. It is your responsibility to check back periodically for changes.

The conditions applicable to the order of a product by a Customer are those in force on the day of validation of his order. Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products.

ORDER

The customer must follow the various steps set up on the website www.lespetitespampillesparis.com to validate his order. The customer must provide his information so that his order is registered. The customer who is not registered must first provide his information to be able to order. After validation of the payment, the customer receives an e-mail informing him that his order has been registered. Any validated order constitutes acceptance of all the stipulations and this takes the value of a contract. It is up to the Customer to verify the accuracy of the information he communicates.

We undertake to honour orders received within the limits of available stocks and in the event of unavailability to inform the customer by any means at their convenience. We will then give you the option of choosing:

1/ to be delivered a product or service of a quality and price equivalent to that ordered.

2/ To be reimbursed for the price of the product or service ordered within 48 hours (this period is the one we will take to initiate the reimbursement by the same means of payment used when placing your order. It may be longer to see the reimbursement appear on your PAYPAL or bank account. This depends on your bank or Paypal).

3/ Wait until the product is available again to be shipped. In this case, the brand agrees to inform you of a restocking time and will deliver the product to you when it is available. In the case of this option, if your order contains several products, we will be able to deliver your order to you, in 2 times maximum.

We will therefore deliver the products available when you place your order and the second part during a second delivery which will be at our expense. The customer can request to receive their entire order in a single shipment. In this case, the deadline will be that of the provision of the product unavailable when the order is placed. The Les Petites Pampilles Paris brand reserves the right to refuse, cancel and terminate orders at any time for legitimate and legal reasons (problems related to payment, history, etc.). In this case, we will inform the Customer.

PRICE

The prices of our products are indicated in euros, all taxes included (VAT and other taxes applicable on the day of the order), unless otherwise indicated and excluding processing and shipping costs (which are identified separately). The brand reserves the right to modify its prices at any time without notice, but products already ordered will be invoiced on the basis of the rates in effect at the time of registration of each order. The products remain the full and entire property of the brand Les Petites Pampilles Paris until full payment of the price of each order.

For deliveries abroad, customs duties, other local taxes, import duties or state taxes may be payable. These duties and sums are not the responsibility of Les Petites Pampilles Paris. They will be your responsibility and are your sole responsibility, both in terms of declarations and payments to the competent authorities and organizations in your country. We advise you to inquire about these aspects with your local authorities.

PAYMENT

Payment for product purchases by Customers is made:

- Either by bank card (via stripe)

- Either by PAYPAL.

Cash or check payments are not accepted. Les Petites Pampilles Paris uses the STRIPE service for credit card payments. Stripe offers one of the most secure payment solutions in the world.

The bank card is debited at the time the order is registered. In the event of a refused bank card transaction, the company invites the Customer to contact their bank, as the company cannot be held responsible. Orders must be paid in full and in one go. Les Petites Pampilles Paris does not have access to the customer's banking information at any time. This is why their payment information will be requested for each new order.

SHIPPING

As the jewelry is handmade, the packages are shipped between 2 and 3 working days.

If the product is urgent, please let us know when placing the order.

For certain specific orders (customization requiring welding and gilding work), this period can be up to 2 to 3 weeks.

The delivery times for letters with tracking and colissimo are:

• 2 to 3 working days for France (according to the Post Office).
• 3 to 8 working days for Europe
• 5 to 10 working days for international

During the holiday season, postal delivery times may be extended.

Delivery is made by choice of:

• FRANCE: Letter with tracking: €3.50. Free delivery from €70 purchase / Colissimo against signature: €8, free delivery from €120.
• EUROPE: Letter with tracking: €6.20. Free delivery from €90 purchase / Colissimo against signature: €12.30. Free delivery from €160.

The cost of delivery takes into account La Poste rates as well as a contribution to shipping costs (logistics, envelopes, etc.).

RISKS RELATED TO DELIVERY

The company Les Petites Pampilles Paris offers you delivery directly to your home or to the address of your choice. The products travel at the risk and peril of the customer, who is responsible, in the event of default or failure, to make all necessary objections and confirm his reservations by extrajudicial act or by registered letter with acknowledgment of receipt to the carrier within three days following receipt of the goods.

We have chosen to ship our orders with the services of the Post Office (letter with tracking or Colissimo with tracking). However, as with any shipment, there may be a delay in delivery.

The company Les Petites Pampilles Paris and the carriers being separate and independent entities, the brand cannot be held responsible for any delay or error in delivery or loss of packages attributable to La Poste. Unless otherwise provided for for each product, orders are delivered to the address indicated when ordering within 10 working days from the order confirmation sent to the customer by the company Les Petites Pampilles Paris.

Any reservations regarding the delivery and receipt of the products must be reported to the carrier within the legal time limits. The tracking number provided by La Poste is valid for two months. No claims can be made beyond this period.

RIGHT OF WITHDRAWAL

In accordance with the provisions of Articles L 221-18 et seq. of the Consumer Code, the Customer may cancel his order without providing any reason. To do so, he has the right to withdraw.

You can exercise it within 14 days from receipt of the Product (the postmark being proof). After this period, we will unfortunately not be able to offer you a refund.

Items purchased in our store (online or physical) or during pop-up events may be subject to a refund or credit.

Before the expiry of this 14-day period, the Customer must inform the company Les Petites Pampilles Paris of his decision to withdraw by email clearly and unambiguously expressing this decision by mentioning the number of his order to: accueil@lespetitespampilles.com .

The Customer must return the Product, at his own expense (unless the product is not compliant or has a manufacturing defect), to the following address: Les Petites Pampilles Paris, 6 bis Boulevard du Général de Gaulle, 92380 Garches, France, within 7 days of communicating his decision to withdraw. If the Order is not returned within the time limit, the Order will be deemed final and no refund will be made, except in the cases provided for in these General Terms and Conditions of Sale.

We strongly advise our customers to make their returns with a tracking number and to communicate it to us when sending the package. We cannot be held responsible for delays and failures in delivery by the service concerned (Post or any other delivery service).

The deadline is extended for all orders placed during the month of December. You have until January 6th to request a credit or refund.

The product must be returned new, in its original packaging (pouch, case, etc.), the reason for the return must be indicated in the package. Regarding returns of personalized products: Article L 121-20-2 of the Consumer Code provides that the right of withdrawal cannot be exercised for contracts for the supply of goods made to the consumer's specifications or clearly personalized. Gift cards cannot be refunded. In the event that an order is part of a particular advertising promotion, the right of withdrawal is canceled.

Refunds for products will be made within 15 business days of receipt of the products by Les Petites Pampilles Paris. The credit will be automatically applied to your credit card or original payment method. We will also notify you of the approval or rejection of your refund.

GUARANTEE

In accordance with article 217-4 of the Consumer Code, the company Les Petites Pampilles Paris will be liable for any lack of conformity (material or manufacturing) which exists at the time of delivery of the product and which appears within one year from this.

If the customer uses the products abnormally or not in accordance with the terms of the contract, the consequences resulting from these uses are excluded from the scope of the current contractual guarantees. The defect will be deemed non-existent if, at the time of conclusion of the contract, the customer was aware of the lack of conformity or could not reasonably be unaware of it or if the lack of conformity is attributable to him. We specify, however, that it is appropriate, in this regard, to take into account the particular nature of our products and that the Customer is required to take care of them, in particular by avoiding any contact of the products with detergents, abrasive products (for example chlorine) or any products containing alcohol. In addition, normal wear and a certain patina linked to repeated wearing of our products can in no case be considered as a lack of conformity within the meaning of this provision. We invite you to read the maintenance and use advice on the site. It is agreed that the Customer must notify us of any lack of conformity, in writing or by e-mail to the following address: accueil@lespetitespampilles.com within the warranty period.

Failure to comply with this obligation will result in the loss of the Customer's rights due to lack of conformity. Interventions under the warranty cannot have the effect of extending the duration of the warranty.

Under this guarantee, the sole obligation of the seller will be the free replacement of the product with an identical product or with any other equivalent product. In the event of unavailability of a pearl or a component of the jewel recognized as subject to the guarantee of conformity, the company reserves the right to replace it in such a way that its general appearance comes as close as possible to its representation and photograph on the site www.lespetitespampillesparis.com The jewels must be returned by letter with tracking or by colissimo against signature in rigid packaging (in particular for earrings) and in their original packaging (pouch, box, etc.). The tracking number must be communicated to the company by email as well as the original number of the order.

The brand will repair or replace the product within a maximum of one month from receipt of the package (the postmark is proof). The return costs will be borne by the customer and the shipping costs of the repaired product will be borne by the company.

REPAIR

If you have broken one of your jewels, or if the guarantee period of it has passed, we can repair it. We only repair jewels of the brand Les Petites Pampilles Paris. This service is chargeable.

For this type of request, do not hesitate to contact our customer service at the following address: accueil@lespetitespampilles.com . Please attach a photo of the jewelry to your email so that we can help you as best we can. After checking the possibility of repairing the jewelry, we will offer you a repair option or not.

The repair and shipping costs will be charged to you. A quote to be validated will be sent to you beforehand.

APPLICABLE LAW AND COMPETENT JURISDICTION

These general terms and conditions of sale are subject to French law. The products offered comply with current French legislation. Les Petites Pampilles Paris cannot be held liable in the event of non-compliance with the legislation of the country where the product is delivered.

It is your responsibility to check with local authorities the possibilities of importing or using the products or services you plan to order. Furthermore, Les Petites Pampilles Paris cannot be held responsible for damage resulting from improper use of the product purchased. In the event of a dispute, an amicable solution will be sought before any legal action.

The liability of Petites Pampilles Paris, under these General Conditions, may not exceed an amount equal to the sums paid or payable during the transaction giving rise to said liability, regardless of the cause or form of the action concerned. The French courts within the jurisdiction of the Paris Court of Appeal shall have sole jurisdiction.

INTELLECTUAL PROPERTY

The intellectual and industrial property rights protecting all elements (texts, comments, images, photographs, logos, drawings, videos, etc.) found on the site www.lespetitespampillesparis.com are the property of Les Petites Pampilles Paris. The jewelry sold on the site www.lespetitespampillesparis.com are all created and designed by the designer herself and are the intellectual property of Les Petites Pampilles Paris. Any total or partial reproduction of one of these elements without the express prior written authorization of the holder of said intellectual and industrial property rights is strictly prohibited, in accordance with the laws governing intellectual and industrial property.
